Pay, Elect or Restructure
The three choices every family trust has to make
If your family runs a business or holds assets through a discretionary trust, a decision is coming. Legislation introduced into Parliament on 14 October 2026 proposes a 30% minimum tax on discretionary trust income from 1 July 2028. It is not yet law, but every family group should start planning now. In practice, each trust will have three choices.

This article is the first in a series running over the next six months, covering topics from the proposed 2028 trust minimum tax and the 2027 to 2030 rollover window to the cost of doing nothing. Each article will explain what the changes mean for your family group and how the right restructure can help you minimise the impact before the new rules take hold.
There is no one size fits all answer. The right path depends on your whole family group, the trading company, bucket company, super fun
d, property and succession plans. Over the coming weeks, we will work through practical examples. If you would like to talk about your group, please get in touch.

General information only, current as at 29/10/2026. The minimum tax, election and rollover measures are contained in Bills before Parliament, are not yet law and may change.
